Union American Catalunya (MC), majority in Catalan public healthcare, has claimed this Monday to the Ombudsman and the parliamentary groups in the Congress that declared “unconstitutional” the cut half of the complement of variable productivity (MBO) received by the doctors of the Catalan Health Institute (ICS).

Physicians have asked both institutions that encourage and develop an action of unconstitutionality against the law of budgets of the Generalitat by 2012, to consider “illegal” this rebate to the Balearic Government applied in April this year on the pay of 2011.

MC accuses the Catalan Executive of infringing a constitutional right, claiming the “non-retroactivity” of sanctions and restrictive provisions of individual rights.

Argues that the productivity of 2011 by the physician responds to about welfare goals set and assessed by the ICS during last year and therefore cuts planned for 2012 is “retroactive and unjust imposition”.

Finally, the Union has accused the Government of infringing the right to legal certainty, by the fact of injure the expectations saliariales doctors had agreed with the ICS if they fulfilled the objectives.
