Barcelona, 2 Dec (EFE).-the Court commercial 2 of Barcelona has urged in a statement to the well-known obstetrician Santiago Dexeus and his sons change their company names by removing the name “Dexeus” and ordered that it is not used in banners, promotional material, and other documents.

Dexeus family has expressed today in a statement its “perplexity and bewilderment” sentence, promoted by the Clinic Dexeus society, of which the famous physician was removed for retirement in 2004.

In addition, announced that they submitted an appeal against the judgement, which also condemns them payment of 12.108,44 euros in compensation for damages and harm.

The statement responds to the demand by society Clinic Dexeus S.L.P., entity in which the Dexeus family developed his professional career until December 2008, which considered that it was harmed by the use of the mark in the “Centre Ginecològic Santiago Dexeus”, “Instituto Santiago Dexeus S.L.P.” and “Foundation School Dexeus”.

In its letter, the judge considered that the “notorious character of the mark increases the risk of confusion” and, in addition, all brands involved in the dispute have purposes similar.

Following the judgment, the Dexeus family also must stop using the website www.santiagodexeus.com.

In its communiqué, the Dexeus family wondered how have to call to their patients and the public in general can identify them in its new professional project, “which has ensured its continuity with the fourth generation of the Dexeus saga”, assures.

This is not the first judgement unfavourable to Santiago Dexeus in the conflict with the health centre which was linked since its inception, since last June another commercial court in Barcelona sentenced to the famous physician compensation with 832.545 euros to the Dexeus clinic for his criticism towards their former partners.

On that occasion, the Court considered that Santiago Dexeus Trias de Bes, son of the creator of the Dexeus Foundation, incurred in an act of unfair competition to denigrate the Dexeus clinic, which was removed by various demonstrations that became public in media.
